Decree of the Reich President on the Granting of Exemption from Punishment
Signed on the ‘Day of Potsdam’, the decree granted an amnesty for crimes committed ‘in the struggle for the national uprising of the German people’, in preparing it, or ‘in the struggle for German soil’. Unserved sentences were remitted, pending proceedings for acts committed before 21 March 1933 were dropped and no new ones were to be opened. It did not name its beneficiaries, but in effect it covered those who had used violence on the regime’s behalf, above all members of the SA and SS.

Decree of the Reich President on the Granting of Exemption from Punishment.
Vom 21. März 1933.
Of 21 March 1933.
Auf Grund des Artikels 48 Abs. 2 der Reichsverfassung wird folgendes verordnet:
On the basis of Article 48, para. 2, of the Reich Constitution, the following is decreed:
§ 1Für Straftaten, die im Kampfe für die nationale Erhebung des Deutschen Volkes, zu ihrer Vorbereitung oder im Kampfe für die deutsche Scholle begangen sind, wird Straffreiheit nach Maßgabe der folgenden Bestimmungen gewährt.
§ 1For criminal offences committed in the struggle for the national uprising of the German people, in preparation for it, or in the struggle for German soil, exemption from punishment is granted in accordance with the following provisions.
§ 2Strafen, die beim Inkrafttreten dieser Verordnung rechtskräftig erkannt und noch nicht verbüßt sind, werden erlassen.
§ 2Sentences that have been finally imposed and not yet served when this decree comes into force are remitted.
Der Straferlaß erstreckt sich auf Nebenstrafen und Sicherungsmaßnahmen, soweit sie noch nicht vollstreckt sind, auf gesetzliche Nebenfolgen, auf rückständige Geldbußen, die in die Kasse des Reichs oder der Länder fließen, und auf rückständige Kosten.
The remission extends to supplementary penalties and security measures, in so far as they have not yet been enforced, to statutory collateral consequences, to outstanding fines payable to the treasury of the Reich or of the states, and to outstanding costs.
Ist auf Einziehung oder Unbrauchbarmachung erkannt, so behält es dabei sein Bewenden.
Where confiscation or the rendering unusable [of objects] has been ordered, that order stands.
§ 3Anhängige Verfahren werden eingestellt, wenn die Tat vor dem 21. März 1933 begangen ist; neue Verfahren werden nicht eingeleitet.
§ 3Pending proceedings are discontinued if the act was committed before 21 March 1933; new proceedings are not to be instituted.
§ 4Enthält eine Gesamtstrafe, die beim Inkrafttreten dieser Verordnung noch nicht verbüßt ist, eine Einzelstrafe wegen einer Zuwiderhandlung, für die Straffreiheit gewährt wird, oder mehrere derartige Einzelstrafen, so wird der Teil der Gesamtstrafe, der nach dem Verhältnis der verwirkten Einzelstrafen auf die genannte Zuwiderhandlung entfällt, von der Gesamtstrafe abgezogen.
§ 4If an aggregate sentence not yet served when this decree comes into force includes an individual sentence for an offence for which exemption from punishment is granted, or several such individual sentences, the part of the aggregate sentence that falls to that offence in proportion to the individual sentences incurred is deducted from the aggregate sentence.
Ist bei der Bildung einer Gesamtstrafe Gefängnisstrafe lediglich deshalb in Zuchthaus umgewandelt worden, weil sie mit Zuchthausstrafe wegen einer Zuwiderhandlung zusammentraf, für die Straffreiheit gewährt wird, so wird die Gesamtstrafe, die nach Abs. 1 gekürzt ist, in Gefängnis von gleicher Dauer umgewandelt.
If, in forming an aggregate sentence, a sentence of imprisonment was converted into penal servitude solely because it coincided with a sentence of penal servitude for an offence for which exemption from punishment is granted, the aggregate sentence as reduced under para. 1 is converted into imprisonment of the same length.
Gerichtliche Entscheidungen (§ 458 der Strafprozeßordnung) darüber, ob und inwieweit eine Gesamtstrafe nach den Vorschriften der Abs. 1, 2 zu mildern ist, werden von dem Gericht erlassen, das für die Entscheidungen über die Einzelstrafe wegen der im Abs. 1 genannten Zuwiderhandlung zuständig ist.
Judicial decisions (§ 458 of the Code of Criminal Procedure) on whether and to what extent an aggregate sentence is to be reduced under paras. 1 and 2 are made by the court competent for decisions on the individual sentence for the offence referred to in para. 1.
§ 5Über die Einstellung anhängiger Verfahren entscheidet auf Antrag der Beteiligten das Gericht. Gegen die Entscheidung findet sofortige Beschwerde statt.
§ 5The court decides on the discontinuance of pending proceedings on the application of the parties concerned. An immediate complaint lies against the decision.
War das Verfahren auf Privatklage eingeleitet, so werden die Kosten des Verfahrens niedergeschlagen. Die dem Privatkläger und dem Beschuldigten erwachsenen notwendigen Auslagen kann das Gericht angemessen verteilen oder einem von ihnen ganz auferlegen.
If the proceedings were instituted by private prosecution, the costs of the proceedings are waived. The court may divide the necessary expenses incurred by the private prosecutor and the accused in a fair manner or impose them entirely on one of them.
§ 6Die Verordnung findet auf die zur Zuständigkeit der Gerichte des Reichs und der Länder gehörenden Strafsachen Anwendung.
§ 6The decree applies to criminal cases within the jurisdiction of the courts of the Reich and of the states.
§ 7Die Verordnung tritt mit dem auf die Verkündung folgenden Tage in Kraft.
§ 7The decree comes into force on the day following its promulgation.

nationale Erhebung
‘National uprising’: the regime’s name for its own coming to power. The decree’s wording limited the amnesty to acts done on the regime’s side.
Kampf für die deutsche Scholle
‘The struggle for German soil’: generally read as a reference to the militant rural protest movement (Landvolkbewegung) of the late 1920s, whose members had carried out bomb attacks on public buildings in Schleswig-Holstein.
Gesamtstrafe
An aggregate sentence: a single sentence formed under the Criminal Code from several individual sentences for separate offences.
Zuchthaus
Penal servitude: a harsher form of imprisonment than Gefängnis, with hard labour and loss of civil rights.
