Decree of the Reich President on Protection of Agriculture against Enforcement
Verordnung des Reichspräsidenten über den landwirtschaftlichen Vollstreckungsschutz
A moratorium for indebted farmers. Until 31 October 1933 farm, forestry and market-garden land could not be sold at forced auction, and creditors could not seize the livestock, equipment and other movable property a farm needed or the farmer’s household goods, subject to exceptions to be set by implementing ordinance; the Reich Government could also restrict evictions. The first implementing ordinance, signed the same day, is printed on the next page of the gazette. Within days associations of craftsmen, innkeepers and house-owners were asking for the same protection.

The full text is given. Transcribed from the RGBl. scan (issue 13, p. 63), where the decree is printed complete; no other transcription was found to compare. The implementing ordinance of the same date on pp. 64 ff. is a separate measure and is not included.
The English translation was made for this site and is not an official translation. The decree contains no provision on when it comes into force. ‘Gärtnerisch’ is translated ‘horticultural’ (market gardens and nurseries).

- Vollstreckungsschutz
- Protection against enforcement: limits on the power of creditors to have a debtor’s property seized and sold through the courts. Emergency decrees since 1931 had already given indebted farmers some protection; this decree widened it.
- Zwangsversteigerung
- A forced auction: the sale of a debtor’s land by court order to satisfy creditors.
- Osthilfe
- ‘Eastern Aid’: the Reich programme, from 1931, of subsidised debt relief for indebted estates and farms in eastern Germany. A holding judged incapable of being freed of debt lost the protection of its ‘Sicherungsverfahren’; Article 2 let such holdings still seek a settlement through mediation.
- Vermittlungsverfahren
- Mediation proceedings under the emergency decree of September 1932, in which a court-appointed mediator sought a settlement between an indebted farmer and his creditors.
