Decree of the Reich President for the Restoration of Orderly Government in Prussia
Verordnung des Reichspräsidenten zur Herstellung geordneter Regierungsverhältnisse in Preußen
The State Court’s judgment of 25 October 1932 had upheld the Reich’s commissioner in Prussia but left the deposed Braun government with some of its rights, so that Prussia had two governments. Declaring that Prussia’s conduct had caused a ‘confusion in the life of the state’, Hindenburg transferred those remaining rights to the Reich Commissioner, Papen, and his appointees. The same day Papen used Braun’s place in the three-man college to dissolve the Prussian Landtag. Unlike most emergency decrees of the period, it rested on the first paragraph of Article 48, the power to compel a state to do its duties, and was countersigned by Papen on the Chancellor’s behalf.

- The first paragraph of the emergency article: if a state failed to fulfil its duties under the constitution or Reich laws, the Reich President could compel it to do so, if necessary with armed force (the ‘Reichsexekution’). Most emergency decrees rested on paragraph 2, the power to restore public security and order.
