Zweite Verordnung zur Durchführung der Verordnung zum Schutze des deutschen Volkes

The decree of 4 February allowed a newspaper ban to be challenged before a senate of the Reich Court. This ordinance set out that senate’s procedure: it decided on the documents, could take written statements and hear witnesses and experts on oath, and was to rule within a week by simple majority, with written reasons. A complainant who lost had to pay a fee of 30 to 600 Reichsmarks. The ban itself stayed in force while the complaint was heard.

Second Ordinance for the Implementation of the Decree for the Protection of the German People.
Vom 7. Februar 1933.
Of 7 February 1933.
Auf Grund des § 25 der Verordnung des Reichspräsidenten zum Schutze des deutschen Volkes vom 4. Februar 1933 (Reichsgesetzbl. I S. 35) wird hiermit verordnet:
On the basis of § 25 of the Decree of the Reich President for the Protection of the German People of 4 February 1933 (Reich Law Gazette I p. 35), it is hereby decreed:
§ 1 Der gemäß § 10 Abs. 1 der Verordnung des Reichspräsidenten zum Schutze des deutschen Volkes bestimmte Senat des Reichsgerichts ist zuständig für die Entscheidung darüber,
§ 1 The senate of the Reich Court designated under § 10, para. 1, of the Decree of the Reich President for the Protection of the German People is competent to decide
1. ob der Beschwerde gegen das Verbot einer periodischen Druckschrift stattzugeben ist, wenn der Reichsminister des Innern ihr nicht abgeholfen hat (§ 10 Abs. 2 Satz 4, § 11 Abs. 3 der Verordnung);
1. whether a complaint against the ban of a periodical is to be upheld, if the Reich Minister of the Interior has not granted it (§ 10, para. 2, sentence 4, § 11, para. 3, of the decree);
2. ob die Entscheidung des Reichsministers des Innern, die der Beschwerde gegen das Verbot einer periodischen Druckschrift abgeholfen hat, aufrechtzuerhalten ist (§ 10 Abs. 2 Satz 5, § 11 Abs. 3 der Verordnung);
2. whether a decision of the Reich Minister of the Interior granting a complaint against the ban of a periodical is to be upheld (§ 10, para. 2, sentence 5, § 11, para. 3, of the decree);
3. ob die oberste Landesbehörde einem Ersuchen des Reichsministers des Innern um das Verbot einer periodischen Druckschrift entsprechen muß (§ 10 Abs. 3, § 11 Abs. 2 der Verordnung).
3. whether the supreme state authority must comply with a request of the Reich Minister of the Interior to ban a periodical (§ 10, para. 3, § 11, para. 2, of the decree).
§ 2 Der Senat entscheidet auf Grund der ihm von den Beteiligten vorgelegten Unterlagen. Zu ihrer Ergänzung kann er von den Beteiligten schriftliche Äußerungen einholen und weitere Erhebungen anstellen, insbesondere Zeugen und Sachverständige eidlich vernehmen. Auf solche Vernehmungen finden die Vorschriften der Strafprozeßordnung entsprechende Anwendung. Die Gerichte sind zur Rechtshilfe nach den Bestimmungen des Titels 13 des Gerichtsverfassungsgesetzes verpflichtet.
§ 2 The senate decides on the basis of the documents submitted to it by the parties concerned. To supplement them it may obtain written statements from the parties and make further inquiries, in particular examine witnesses and experts on oath. The provisions of the Code of Criminal Procedure apply correspondingly to such examinations. The courts are obliged to give judicial assistance in accordance with the provisions of Title 13 of the Courts Constitution Act.
Der Senat kann mündliche Verhandlung anordnen, zu der die Beteiligten zu laden sind. Die mündliche Verhandlung ist öffentlich. Die Vorschriften der §§ 172, 174 bis 179, 182, 183 und des Titels 15 des Gerichtsverfassungsgesetzes finden Anwendung.
The senate may order an oral hearing, to which the parties are to be summoned. The oral hearing is public. The provisions of §§ 172, 174 to 179, 182 and 183 and of Title 15 of the Courts Constitution Act apply.
Zwischen der Zustellung der Ladung und der mündlichen Verhandlung muß eine Frist von mindestens drei Tagen liegen. Mit Zustimmung der Beteiligten ist Abkürzung dieser Frist zulässig.
A period of at least three days must elapse between the service of the summons and the oral hearing. With the consent of the parties, this period may be shortened.
§ 3 Auf die Ausschließung und Ablehnung der Gerichtspersonen finden die Vorschriften des 1. Buches, 1. Abschnitts, Titels 4 der Zivilprozeßordnung entsprechende Anwendung.
§ 3 The provisions of Book 1, Section 1, Title 4 of the Code of Civil Procedure apply correspondingly to the exclusion and challenge of court officers.
§ 4 Die Entscheidung des Senats über das Verbot einer periodischen Druckschrift soll innerhalb einer Woche nach dem Tage ergehen, an dem das Ersuchen um die Entscheidung des Senats bei ihm eingegangen ist.
§ 4 The senate’s decision on the ban of a periodical should be given within one week of the day on which the request for the senate’s decision reached it.
§ 5 Die Entscheidungen des Senats erfolgen mit einfacher Mehrheit der Stimmen.
§ 5 The decisions of the senate are taken by a simple majority of votes.
Die Entscheidungen sind schriftlich zu begründen und den Beteiligten zuzustellen.
Reasons for the decisions are to be given in writing, and the decisions are to be served on the parties.
§ 6 Als Beteiligte gemäß §§ 2 und 5 gelten
§ 6 The following count as parties within the meaning of §§ 2 and 5:
1. im Falle des § 1 Nr. 1
1. in the case of § 1, no. 1:
a) der Reichsminister des Innern,
a) the Reich Minister of the Interior,
b) die oberste Landesbehörde,
b) the supreme state authority,
c) die Landesbehörde, die das Verbot der periodischen Druckschrift angeordnet hat,
c) the state authority which ordered the ban of the periodical,
d) der verantwortliche Schriftleiter und der Verleger der periodischen Druckschrift;
d) the responsible editor and the publisher of the periodical;
2. im Falle des § 1 Nr. 2 und 3
2. in the case of § 1, nos. 2 and 3:
a) der Reichsminister des Innern,
a) the Reich Minister of the Interior,
b) die oberste Landesbehörde.
b) the supreme state authority.
Die Beteiligten können sich in dem Verfahren durch Bevollmächtigte vertreten lassen.
The parties may be represented in the proceedings by authorised representatives.
§ 7 Die Zustellung der Ladungen und der Entscheidungen erfolgt nach den Vorschriften der Zivilprozeßordnung über die Zustellungen von Amts wegen (§§ 208 ff.).
§ 7 Summonses and decisions are served in accordance with the provisions of the Code of Civil Procedure on service by the court of its own motion (§§ 208 et seq.).
§ 8 Die Verfahren werden durch die Gerichtsferien nicht gehemmt.
§ 8 The proceedings are not suspended by the court vacation.
§ 9 Wird im Fall des § 1 Nr. 1 die Beschwerde ganz oder teilweise verworfen, so hat der Beschwerdeführer eine Gebühr zu zahlen, die vom Senat durch besonderen Beschluß festgesetzt wird. Der Senat kann zugleich dem Beschwerdeführer auferlegen, die Auslagen des Gerichts ganz oder teilweise zu erstatten.
§ 9 If in the case of § 1, no. 1, the complaint is dismissed in whole or in part, the complainant must pay a fee, which is fixed by the senate in a separate order. The senate may at the same time require the complainant to reimburse the court’s expenses in whole or in part.
§ 10 Die Gebühr beträgt mindestens 30 Reichsmark und höchstens 600 Reichsmark.
§ 10 The fee is at least 30 Reichsmarks and at most 600 Reichsmarks.
Für die Auslagen gelten die Vorschriften der §§ 71 bis 73 des Gerichtskostengesetzes.
The provisions of §§ 71 to 73 of the Court Costs Act apply to the expenses.
Die Einziehung der Gebühren und Auslagen erfolgt nach den Vorschriften über die Gerichtskosten in reichsgerichtlichen Verfahren.
Fees and expenses are collected in accordance with the provisions on court costs in proceedings before the Reich Court.
§ 11 Ein Verfahren, das bei Inkrafttreten der Verordnung des Reichspräsidenten vom 4. Februar 1933 auf Grund des § 6 der Verordnung des Reichspräsidenten zur Erhaltung des inneren Friedens vom 19. Dezember 1932 (Reichsgesetzbl. I S. 548) eingeleitet war, wird nach den Vorschriften der Verordnung vom 4. Februar 1933 und dieser Durchführungsverordnung fortgesetzt; jedoch finden die Bestimmungen der §§ 9 und 10 der Durchführungsverordnung über die Gebühren und Auslagen in dem Verfahren vor dem Senat des Reichsgerichts keine Anwendung.
§ 11 Proceedings which had been instituted under § 6 of the Decree of the Reich President for the Preservation of Internal Peace of 19 December 1932 (Reich Law Gazette I p. 548) when the Decree of the Reich President of 4 February 1933 came into force are continued under the provisions of the decree of 4 February 1933 and of this implementing ordinance; however, the provisions of §§ 9 and 10 of the implementing ordinance on fees and expenses do not apply in the proceedings before the senate of the Reich Court.

Terms

Senat des Reichsgerichts
A senate (panel of judges) of the Reich Court in Leipzig, Germany’s highest court in civil and criminal matters, designated by its presiding board to hear complaints against bans of periodicals.
periodische Druckschrift
A periodical: any newspaper or magazine appearing at regular intervals. Under the decree of 4 February a daily paper could be banned for up to four weeks, other periodicals for up to six months.
Beschwerde
A complaint (appeal) against an administrative order. Under § 10 of the decree it did not suspend the ban, which stayed in force while the complaint was heard.
Verordnung zur Erhaltung des inneren Friedens
The emergency decree of 19 December 1932, issued under Chancellor Kurt von Schleicher, which replaced earlier emergency decrees against political violence. The decree of 4 February 1933 set several of its provisions aside (§ 26).
Gerichtsferien
The court vacation, a fixed summer period during which ordinary proceedings were suspended.
