Decree on the Dissolution of the Representative Bodies of the Municipalities and Associations of Municipalities; Decree Fixing the Polling Day for the New Municipal Elections
Two decrees adopted by the Reich’s commissioners running the Prussian ministries, on Göring’s proposal as commissioner for the interior. The first dissolved every elected local body in Prussia at once: the provincial diets, the district councils, the town and village councils, Berlin’s borough assemblies and the assemblies of the Ämter in the Rhineland and Westphalia, all elected in November 1929. The second set new elections for 12 March 1933 and allowed the interior minister to depart from the time limits of the local electoral laws. Göring argued that the councils no longer reflected the will of the population; the Social Democrats in the Landtag called the dissolution unlawful.

The full text is given. No scan of the Preußische Gesetzsammlung (1933, p. 21, the page given in the Akten der Reichskanzlei) was found on Wikimedia Commons, and documentArchiv.de does not carry these decrees. The text rests on the ‘amtliche Wortlaut’ issued by the Amtlicher Preußischer Pressedienst and reprinted in the Gelsenkirchener Allgemeine Zeitung, no. 37, 6 February 1933, p. 1, read from the page image digitised by ULB Münster; it has not been checked against the Gesetzsammlung. The reprint signs both decrees only ‘Das Preußische Staatsministerium: (Die Kommissare des Reiches.)’, without individual names, and its likely misprints are kept as printed: ‘Landeskummunalverband’ (decree I; ‘Landkommunalverband’ in decree II), ‘der übrigen Städteordnung’ and ‘der Stadt- und Landgemeinde’, where decree II has the plural. No scan of the original publication was available to check the transcription against.
The English translation was made for this site and is not an official translation. Where the reprint has a singular that is probably a misprint (‘der übrigen Städteordnung’, ‘der Stadt- und Landgemeinde’), the translation follows it. The same press release also carried a resolution of the State Ministry setting 12 March as polling day for the district councils of newly formed districts; it is not part of these decrees and is not included. Prussian institutions are translated with their usual English equivalents: Provinziallandtag ‘provincial diet’, Kreistag ‘district council’, Gemeindevertretung ‘municipal council’.

- Kommissare des Reiches
- The commissioners of the Reich who had run the Prussian ministries since the ‘Prussian coup’ of 20 July 1932, under the Reich Commissioner for Prussia, Vice-Chancellor von Papen. On 4 February 1933 they acted as the Prussian State Ministry; the commissioner for the interior was Hermann Göring.
- Vertretungskörperschaften
- The elected representative bodies of local government: provincial diets, district councils, town and village councils and the like. They had last been elected on 17 November 1929.
- Amtsvertretungen
- The assemblies of the Ämter, associations of rural municipalities in the Rhine Province and Westphalia.
- Kommunallandtage Wiesbaden und Kassel; Hohenzollerische Lande
- The province of Hesse-Nassau had two district associations (Bezirksverbände) with their own diets, and the Hohenzollern Lands in southern Germany a communal association of their own; all were dissolved with the provincial diets.
- Verordnung vom 24. August 1931
- The ‘Dietramszell’ emergency decree of the Reich President, which allowed state governments to take, by decree, any measures needed to balance the budgets of states and municipalities, departing from state law. The commissioners rested the second decree on it, on the argument that it would save money.
- Neuvorpommern und Rügen
- Western Pomerania north of the Peene and the island of Rügen, Swedish until 1815. Like the province of Hanover, they are named in a sentence of their own.
