Verordnung zur Durchführung des Reichswahlgesetzes

Frick’s ordinance put the President’s amendment of the electoral law of 2 February into practice. It set out how Germans living abroad who were in Germany on polling day, and crews of sea and river vessels without a fixed home ashore, could obtain voting certificates and prove who they were. It also laid down the signature rule for the election: twenty voters sufficed for a constituency list of a party already represented in the Reichstag, while any other party needed 60,000 certified signatures, collected municipality by municipality on a prescribed form.

Auf Grund der Verordnung des Reichspräsidenten über Änderung des Reichswahlgesetzes vom 2. Februar 1933 (Reichsgesetzbl. I S. 45) wird verordnet:
On the basis of the Decree of the Reich President on the Amendment of the Reich Electoral Law of 2 February 1933 (Reich Law Gazette I p. 45), it is decreed:
I. Stimmscheine für Auslanddeutsche und Angehörige der Besatzung von See- oder Binnenschiffen
I. Voting certificates for Germans living abroad and members of the crews of sea-going or inland vessels
§ 1 Außer in den Fällen des § 9 der Verordnung über Reichswahlen und -abstimmungen (Reichsstimmordnung) vom 14. März 1924 (Reichsgesetzbl. I S. 173) erhält einen Stimmschein auf Antrag ein Wähler, der nicht in eine Stimmliste oder Stimmkartei eingetragen oder darin gestrichen ist,
§ 1 In addition to the cases of § 9 of the Ordinance on Reich Elections and Referendums (Reich Voting Regulations) of 14 March 1924 (Reich Law Gazette I p. 173), a voter who is not entered in an electoral register or electoral card index, or has been struck off it, receives a voting certificate on application
1. wenn er Auslanddeutscher ist und sich am Wahltag (Abstimmungstag) im Inland aufhält;
1. if he is a German living abroad and is present within the country on polling day (voting day);
2. wenn er zur Besatzung von See- oder Binnenschiffen gehört und für keinen festen Landwohnsitz polizeilich gemeldet ist.
2. if he belongs to the crew of a sea-going or inland vessel and is not registered with the police at any fixed residence on land.
§ 2 Auslanddeutsche im Sinne des § 1 Nr. 1 sind Reichsangehörige, die im Auslande ihren Wohnsitz oder ständigen Aufenthalt haben. Als Auslanddeutsche gelten auch Reichsangehörige, die im Ausland als Beamte, Angestellte oder Arbeiter des Reichs, eines deutschen Landes oder der Deutschen Reichsbahn-Gesellschaft angestellt sind oder als Familienangehörige und Hausangestellte in ihrem Haushalt leben.
§ 2 Germans living abroad within the meaning of § 1, no. 1, are Reich nationals who have their domicile or permanent residence abroad. Reich nationals who are employed abroad as civil servants, salaried employees or workers of the Reich, of a German state or of the German State Railway Company, or who live in their household as members of their family or domestic servants, also count as Germans living abroad.
§ 3 Stimmscheine für Auslanddeutsche (§ 1 Nr. 1) stellt die für den Wohnort im Auslande zuständige diplomatische oder konsularische Vertretung des Reichs oder die Gemeindebehörde des Aufenthaltsortes im Inlande, für See- oder Binnenschiffer (§ 1 Nr. 2) die Gemeindebehörde des Aufenthaltsortes aus.
§ 3 Voting certificates for Germans living abroad (§ 1, no. 1) are issued by the diplomatic or consular mission of the Reich responsible for their place of residence abroad or by the municipal authority of their place of stay within the country; for seamen and inland boatmen (§ 1, no. 2), by the municipal authority of their place of stay.
§ 4 (1) Die Antragsteller haben sich über ihre Berechtigung, den Antrag zu stellen und den Stimmschein in Empfang zu nehmen, gehörig auszuweisen. Auslanddeutsche weisen sich durch einen Reisepaß oder einen im kleinen Grenzverkehr eingeführten Ausweis aus. Beamte, Angestellte oder Arbeiter des Reichs, eines Landes oder der Deutschen Reichsbahn-Gesellschaft können sich durch die erwähnten Ausweispapiere oder einen Dienstausweis oder eine Bescheinigung der Beschäftigungsbehörde ausweisen. Seeleute weisen sich durch ihr Seefahrtsbuch aus; Binnenschiffer müssen ihren Beruf nachweisen.
§ 4 (1) Applicants must duly prove their identity and their entitlement to make the application and to receive the voting certificate. Germans living abroad prove their identity by a passport or by a pass introduced for local border traffic. Civil servants, salaried employees or workers of the Reich, of a state or of the German State Railway Company may prove their identity by the identity papers mentioned, or by an official identity card, or by a certificate from the authority employing them. Seamen prove their identity by their seaman’s book; inland boatmen must prove their occupation.
(2) Anträge auf Ausstellung von Stimmscheinen für Auslanddeutsche sind auch in größeren Gemeinden noch am letzten Tage vor der Abstimmung (Wahl) innerhalb der an diesem Tage üblichen Dienststunden entgegenzunehmen und zu erledigen.
(2) Applications for the issue of voting certificates to Germans living abroad are to be accepted and dealt with, even in the larger municipalities, up to the last day before the vote (election), within the usual office hours of that day.
(3) Die Tatsache der Erteilung des Stimmscheins ist auf dem vorgelegten Ausweis, in Reisepässen möglichst auf der letzten Seite, unter Bezeichnung der Wahl oder Abstimmung durch die den Stimmschein ausstellende Behörde zu vermerken. Der Vermerk wird mit Amtsstempel versehen.
(3) The fact that the voting certificate has been issued is to be noted by the issuing authority on the identity document produced, in passports if possible on the last page, stating the election or vote. The note is to bear the official stamp.
§ 5 (1) Über die ausgestellten Stimmscheine führt die ausstellende Behörde ein Verzeichnis.
§ 5 (1) The issuing authority keeps a register of the voting certificates issued.
(2) Die diplomatische oder konsularische Vertretung des Reichs, die Stimmscheine nach § 3 dieser Verordnung erteilt hat, zeigt die Zahl der ausgestellten Stimmscheine spätestens am Tage nach dem Wahltage (Abstimmungstage) dem Reichswahlleiter an.
(2) A diplomatic or consular mission of the Reich that has issued voting certificates under § 3 of this ordinance reports the number of voting certificates issued to the Reich Returning Officer no later than the day after polling day (voting day).

§ 6 (1) Bei Kreiswahlvorschlägen von Wählergruppen (Parteien), die mindestens einen Abgeordneten in den letzten Reichstag entsandt hatten, genügt die Unterzeichnung durch mindestens zwanzig Wähler des Wahlkreises. Andere Kreiswahlvorschläge müssen von mindestens 60 000 Wählern des Wahlkreisverbandes unterzeichnet sein.
§ 6 (1) For constituency lists of groups of voters (parties) which had sent at least one deputy to the last Reichstag, signature by at least twenty voters of the constituency suffices. Other constituency lists must be signed by at least 60,000 voters of the constituency association.
(2) Werden Kreiswahlvorschläge mit Unterschriften von mindestens 60 000 Wählern eingereicht, so sind die Unterschriften gemeindeweise in Unterschriftsbogen in Größe 210 zu 297 mm (Din A 4) nach dem in der Anlage beigefügten Vordruck abzugeben. In städtischen Gemeinden sind die Unterschriftsbogen nach dem in der Gemeinde eingeführten System der Stimmkartei (Stimmliste) nach Stadtbezirken, Straßen und Hausnummern oder in der sonst in der Gemeinde eingeführten Aufteilung zu gliedern. Jeder Unterschriftsbogen hat am Kopfe die Namen der Bewerber unter Angabe ihres Berufes oder Standes und ihrer Wohnung zu enthalten. Die Unterschriften sind innerhalb eines Bogens mit fortlaufenden Zahlen zu versehen. Auf einer Seite des Unterschriftsblattes sollen nicht mehr als zwanzig Unterschriften stehen.
(2) Where constituency lists are submitted with the signatures of at least 60,000 voters, the signatures are to be given municipality by municipality on signature sheets measuring 210 by 297 mm (DIN A4), following the form attached in the annex. In urban municipalities the signature sheets are to be arranged according to the system of electoral card index (electoral register) used in the municipality, by city district, street and house number, or by whatever other division is used in the municipality. Each signature sheet must carry at its head the names of the candidates, with their occupation or status and their address. The signatures on each sheet are to be numbered consecutively. There should be no more than twenty signatures on one side of a signature sheet.
(3) Die Unterzeichner des Kreiswahlvorschlags haben ihr Stimmrecht durch eine Bestätigung der Gemeindebehörde nachzuweisen. Die Bestätigung ist in der Regel auf den Unterschriftsbogen selbst zu erteilen. Sie geschieht auf Grund der in der Gemeinde zuletzt benutzten oder laufend geführten Stimmliste oder Stimmkartei oder nach besonderer Feststellung, wenn die Unterzeichner in die Stimmliste oder Stimmkartei nicht eingetragen sind.
(3) The signatories of the constituency list must prove their right to vote by a confirmation from the municipal authority. As a rule the confirmation is to be given on the signature sheets themselves. It is given on the basis of the electoral register or electoral card index last used or currently kept in the municipality, or after a special inquiry if the signatories are not entered in the electoral register or card index.
(4) Die Unterzeichner des Kreiswahlvorschlags haben sich in die Unterschriftsbogen eigenhändig, sorgfältig und leserlich einzutragen. Bei der Unterschrift sind Zu- und Vorname, Beruf oder Stand sowie die Wohnung anzugeben.
(4) The signatories of the constituency list must enter themselves on the signature sheets in their own hand, carefully and legibly. With the signature, surname and first name, occupation or status, and address are to be given.
(5) Bei Einreichung der Unterschriftsbogen an den Kreiswahlleiter müssen diese nach Gemeinden und Bezirken der unteren Verwaltungsbehörde geordnet und mit fortlaufenden Nummern versehen sein. Gleichzeitig ist eine Zusammenstellung über die Zahl der in den einzelnen Unterschriftsbogen bestätigten Unterschriften einzureichen; in dieser Zusammenstellung sind die laufenden Nummern der Bogen einzutragen und ist die Zahl der Unterschriften aufzurechnen.
(5) When the signature sheets are submitted to the constituency returning officer, they must be arranged by municipality and by district of the lower administrative authority and numbered consecutively. At the same time a summary of the number of confirmed signatures on each signature sheet is to be submitted; in this summary the serial numbers of the sheets are to be entered and the number of signatures added up.
§ 7 Weist eine Wählergruppe (Partei) durch die Bescheinigung eines Kreiswahlleiters nach, daß sie der Bedingung des § 6 Abs. 1 Satz 2 dieser Verordnung entsprechend für einen ihrer Kreiswahlvorschläge 60 000 Unterschriften beigebracht hat, so genügt für jeden ihrer anderen Kreiswahlvorschläge die Unterzeichnung von fünfzig Wählern des Wahlkreises, wenn diese Kreiswahlvorschläge durch Verbindung im Verbande oder durch Anschluß an einen Reichswahlvorschlag mit dem Kreiswahlvorschlag mit mindestens 60 000 Unterzeichnern in Zusammenhang gebracht sind. Diese Kreiswahlvorschläge werden unter dem Vorbehalt der Zulassung des Kreiswahlvorschlags mit mindestens 60 000 Unterschriften zugelassen.
§ 7 If a group of voters (party) proves by a certificate from a constituency returning officer that, in accordance with the condition of § 6, para. 1, sentence 2, of this ordinance, it has produced 60,000 signatures for one of its constituency lists, the signatures of fifty voters of the constituency suffice for each of its other constituency lists, provided that these constituency lists are connected with the constituency list with at least 60,000 signatories by being linked within the association or by joining a Reich list. These constituency lists are admitted subject to the admission of the constituency list with at least 60,000 signatures.
§ 8 Die Vorschrift des § 49 Abs. 4 der Verordnung über Reichswahlen und -abstimmungen vom 14. März 1924 (Reichsgesetzbl. I S. 173) tritt insoweit außer Kraft, als sie sich auf Kreiswahlvorschläge bezieht.
§ 8 The provision of § 49, para. 4, of the Ordinance on Reich Elections and Referendums of 14 March 1924 (Reich Law Gazette I p. 173) ceases to have effect in so far as it relates to constituency lists.

Stimmschein
A voting certificate, allowing its holder to vote at any polling station, for instance while travelling, instead of the one where he or she was registered.
Reichsstimmordnung
The Reich Voting Regulations of 14 March 1924: the detailed rules for conducting Reichstag elections and national referendums.
Stimmliste, Stimmkartei
The electoral register, kept by the municipality either as a list or, in larger towns, as a card index.
Kreiswahlvorschlag
A constituency list: a party’s list of candidates in one of the 35 Reichstag constituencies.
Reichswahlvorschlag
A Reich list: a party’s national list, to which its constituency lists could be joined so that votes left over in the constituencies counted towards further seats.
Kreiswahlleiter, Reichswahlleiter
The returning officers for a constituency and for the Reich as a whole.
