Ordinance on the Reichstag Election
Verordnung zur Reichstagswahl
The practical arrangements for the election of 5 March. Travellers holding voting certificates could vote at special polling stations in 47 railway stations, nine of them in Berlin, with voting hours fitted to the trains, and visitors to the Leipzig Fair at special polling districts in the city. It fixed the ballot numbers of the fourteen parties represented in the outgoing Reichstag, with the NSDAP first and the Communist Party third, and made rules for seamen, for voting on board German ships at sea, and for shorter polling hours in small rural districts.

Auf Grund der §§ 61 Abs. 2 und 167 der Reichsstimmordnung vom 14. März 1924 (Reichsgesetzbl. I S. 173) in der Fassung der Fünften Änderungsverordnung zur Reichsstimmordnung vom 24. Juli 1930 (Reichsgesetzbl. I S. 353) wird hiermit für die Reichstagswahl am 5. März 1933 verordnet:
On the basis of §§ 61, para. 2, and 167 of the Reich Voting Regulations of 14 March 1924 (Reich Law Gazette I p. 173), in the version of the Fifth Ordinance Amending the Reich Voting Regulations of 24 July 1930 (Reich Law Gazette I p. 353), the following is hereby decreed for the Reichstag election on 5 March 1933:
I.Stimmabgabe im Reiseverkehr
I.Voting while travelling
§ 1Für Reisende mit Stimmscheinen, denen sich keine Möglichkeit zur Stimmabgabe in einem allgemeinen Abstimmungsraum (§ 41 Reichsstimmordnung) bietet, werden auf einigen großen Übergangsbahnhöfen des innerdeutschen Personenverkehrs sowie auf einigen Übergangsbahnhöfen an der Reichsgrenze besondere Stimmbezirke mit Abstimmungsräumen oder wenigstens besondere Abstimmungsräume eingerichtet (Stimmabgabe im Reiseverkehr), und zwar auf folgenden Bahnhöfen der Deutschen Reichsbahn:
§ 1For travellers with voting certificates who have no opportunity to vote in a general polling room (§ 41 of the Reich Voting Regulations), special polling districts with polling rooms, or at least special polling rooms, are set up at a number of large interchange stations of internal German passenger traffic and at a number of interchange stations on the Reich frontier (voting while travelling), namely at the following stations of the German State Railway:
Aachen main station; Augsburg; Bentheim; Berlin Anhalter station; [Berlin] Friedrichstraße; [Berlin] Görlitzer station; [Berlin] Lehrter station; [Berlin] Potsdamer station; [Berlin] Schlesischer station; [Berlin] Stettiner station; [Berlin] Zoologischer Garten; Bremen main station; Breslau main station; Charlottenburg; Cranenburg; Deutsch-Eylau; Dresden main station; Emmerich; Erfurt; Flensburg; Frankfurt am Main main station; Freiburg im Breisgau; Friedrichshafen (harbour station); Groß Boschpol (Pomerania); Hagenow Land; Hamburg main station; Hanover main station; Insterburg; Karlsruhe main station; Kehl; Koblenz; Cologne main station; Königsberg; Leipzig main station; Lindau; Marienburg; Munich main station; Münster (Westphalia) main station; Nuremberg main station; Passau; Regensburg; Saßnitz harbour; Stettin; Stuttgart main station; Tilsit; Trier; Warnemünde.
§ 2Die zur Abgrenzung der Stimmbezirke berufenen Behörden (§ 165 Reichsstimmordnung), die für die im § 1 aufgeführten Bahnhöfe in Betracht kommen, setzen sich wegen Bereitstellung geeigneter Bahnhofsräume (in Wartesälen usw.) mit den zuständigen Reichsbahndirektionen in Verbindung. Die Abstimmungsräume sind durch Aushänge und Hinweistafeln kenntlich zu machen.
§ 2The authorities appointed to define the polling districts (§ 165 of the Reich Voting Regulations) that are concerned with the stations listed in § 1 shall contact the competent Reich Railway Directorates about the provision of suitable station premises (in waiting rooms, etc.). The polling rooms are to be marked by notices and signboards.
§ 3Für die Stimmabgabe im Reiseverkehr werden von der zur Abgrenzung der Stimmbezirke zuständigen Behörde nach Benehmen mit der zuständigen Reichsbahndirektion besondere Abstimmungszeiten den Bedürfnissen des Reiseverkehrs entsprechend festgesetzt. Die Abstimmungszeiten müssen innerhalb der 24 Stunden des allgemeinen Wahltages liegen. Der Abstimmungsvorstand besteht aus dem Abstimmungsvorsteher oder seinem Stellvertreter und zwei bis sechs Beisitzern. Für einzelne Zeitabschnitte können gesonderte Abstimmungsvorstände bestellt werden. Dem Kreiswahlleiter ist über Einrichtung der Stimmbezirke und Abstimmungszeiten Mitteilung zu machen.
§ 3For voting while travelling, the authority responsible for defining the polling districts shall, after consulting the competent Reich Railway Directorate, fix special voting hours to suit the needs of passenger traffic. The voting hours must fall within the 24 hours of the general polling day. The polling committee consists of the presiding officer or his deputy and two to six assessors. Separate polling committees may be appointed for particular periods. The constituency returning officer is to be informed of the setting up of the polling districts and of the voting hours.
§ 4(1) Bei Ablösung eines Abstimmungsvorstandes werden Stimmurne, Stimmscheine, Stimmzettel, Wahlumschläge, Abstimmungsniederschrift usw. dem nächstfolgenden Abstimmungsvorstand übergeben. Hierbei wird festgestellt, daß die Stimmurne verschlossen ist und wieviel Stimmscheine bisher abgegeben sind. Die Übergabe ist in der Abstimmungsniederschrift zu vermerken. Der Vermerk wird von dem übergebenden und dem übernehmenden Abstimmungsvorstand durch Unterschrift anerkannt.
§ 4(1) When a polling committee is relieved, the ballot box, voting certificates, ballot papers, ballot envelopes, polling record, etc. are handed over to the next polling committee. It is established at the same time that the ballot box is locked and how many voting certificates have been handed in so far. The handover is to be noted in the polling record. The note is acknowledged by the signatures of the outgoing and the incoming polling committee.
(2) Wird die Stimmabgabe unterbrochen, so wird der Spalt der Stimmurne mit amtlichen Siegeln verschlossen. Die Stimmurne, die Stimmscheine, der Vorrat an Stimmzetteln und Wahlumschlägen, die Abstimmungsniederschrift und sonstige Abstimmungspapiere werden bis zum Beginn der nächsten Abstimmungszeit amtlich verwahrt oder unter ständiger amtlicher Aufsicht gehalten. Im Falle der Unterbrechung genügt es, wenn von dem nächstfolgenden Abstimmungsvorstand der Abstimmungsvorsteher oder sein Stellvertreter und ein Beisitzer der Übernahme beiwohnen.
(2) If voting is interrupted, the slot of the ballot box is closed with official seals. The ballot box, the voting certificates, the supply of ballot papers and ballot envelopes, the polling record and other polling papers are kept in official custody, or under constant official supervision, until the beginning of the next voting period. In the case of an interruption it is sufficient if the presiding officer or his deputy and one assessor of the next polling committee attend the takeover.
§ 5(1) Wird die Abstimmung um 6 Uhr nachmittags oder früher beendet, so stellt der zuletzt tätige Abstimmungsvorstand nur die Zahl der abgegebenen Umschläge und Stimmscheine fest. Die ungeöffneten Umschläge versiegelt der Abstimmungsvorsteher oder sein Stellvertreter in Gegenwart der übrigen Mitglieder des Abstimmungsvorstandes in einem Paket, das er mit der Abstimmungsniederschrift und den abgegebenen Stimmscheinen unverzüglich dem Abstimmungsvorsteher des nächstgelegenen allgemeinen Stimmbezirks übergibt, der die Stimmen zusammen mit den Stimmen seines allgemeinen Stimmbezirks verrechnet.
§ 5(1) If voting ends at 6 p.m. or earlier, the last polling committee on duty establishes only the number of envelopes and voting certificates handed in. The presiding officer or his deputy, in the presence of the other members of the polling committee, seals the unopened envelopes in a parcel, which, together with the polling record and the voting certificates handed in, he hands over without delay to the presiding officer of the nearest general polling district, who counts the votes together with the votes of his general polling district.
(2) Endigt die Abstimmung nach 6 Uhr nachmittags, so stellt der zuletzt tätige Abstimmungsvorstand das Ergebnis fest und gibt es nach § 124 Reichsstimmordnung weiter.
(2) If voting ends after 6 p.m., the last polling committee on duty establishes the result and passes it on in accordance with § 124 of the Reich Voting Regulations.
§ 6Im übrigen gelten die allgemeinen Wahlvorschriften auch für die Stimmabgabe im Reiseverkehr.
§ 6In all other respects the general electoral provisions also apply to voting while travelling.
§ 7Die durch Einrichtung der Stimmabgabe im Reiseverkehr den Gemeinden erwachsenden Barauslagen werden voll vom Reiche getragen.
§ 7The cash outlays incurred by the municipalities in setting up voting while travelling are borne in full by the Reich.
II.Stimmabgabe auf der Leipziger Messe

§ 8Der Oberbürgermeister von Leipzig wird ermächtigt, mit Rücksicht auf die Leipziger Messe am Wahltage auf dem Meßgelände sowohl wie im Innern der Stadt Leipzig besondere Stimmbezirke mit Abstimmungsräumen einzurichten. Für diese Stimmbezirke kann die Abstimmungszeit auf den ganzen Wahltag ausgedehnt werden. Im übrigen gelten für diese besonderen Abstimmungsbezirke die Vorschriften über die Stimmabgabe im Reiseverkehr entsprechend.
§ 8In view of the Leipzig Fair, the Lord Mayor of Leipzig is empowered to set up special polling districts with polling rooms on polling day both on the fairground and in the centre of the city of Leipzig. For these polling districts the voting hours may be extended to the whole of polling day. In all other respects the provisions on voting while travelling apply correspondingly to these special polling districts.

§ 9Die Nummernfolge der Reichswahlvorschläge der Parteien, die Abgeordnete in den letzten Reichstag entsandt haben, oder zu denen sich Abgeordnete des letzten Reichstags bekannt haben, ist folgende:
§ 9The numbering of the Reich lists of the parties which sent deputies to the last Reichstag, or to which deputies of the last Reichstag have declared their adherence, is as follows:

§ 10Parteien, die im letzten Reichstag durch Abgeordnete vertreten waren, können auf einen beim Reichsminister des Innern zu stellenden Antrag statt der ihnen zufolge ihres Anschlusses an den Reichswahlvorschlag einer anderen Partei nach § 62 Abs. 3 Reichsstimmordnung zustehenden Nummer mit Buchstabenzusatz für ihre Kreiswahlvorschläge die Nummer behalten, die ihnen nach § 9 dieser Verordnung zusteht.
§ 10Parties which were represented by deputies in the last Reichstag may, on an application to be made to the Reich Minister of the Interior, keep for their constituency lists the number to which they are entitled under § 9 of this ordinance, instead of the number with an added letter to which they would be entitled under § 62, para. 3, of the Reich Voting Regulations by joining the Reich list of another party.
§ 11Im übrigen erhalten Parteien, die ihren Anschluß an den Reichswahlvorschlag einer anderen Partei erklären, auf dem Stimmzettel die Nummer dieses Reichswahlvorschlags mit Buchstabenzusatz nach § 62 Abs. 3 Reichsstimmordnung nur, wenn sie innerhalb der Frist zur Einreichung der Anschlußerklärung eine Zustimmung darüber beibringen, daß der Vertrauensmann des Reichswahlvorschlags, an den der Anschluß erklärt ist, mit dem Anschluß einverstanden ist. Andernfalls erhalten sie die Nummer nach § 62 Abs. 2 Satz 2 Reichsstimmordnung.
§ 11Otherwise, parties which declare that they join the Reich list of another party receive on the ballot paper the number of that Reich list with an added letter under § 62, para. 3, of the Reich Voting Regulations only if, within the time limit for submitting the declaration of joining, they produce a consent showing that the agent of the Reich list they are joining agrees to their joining it. Otherwise they receive the number under § 62, para. 2, sentence 2, of the Reich Voting Regulations.

§ 12(1) Als Seeleute im Sinne des § 111a Reichsstimmordnung sind besonders auch zu behandeln:
§ 12(1) The following in particular are also to be treated as seamen within the meaning of § 111a of the Reich Voting Regulations:
a)Handelsschiffskapitäne, die sich durch ihr Patent ausweisen, und alle sonstigen zur Besatzung eines Handelsschiffes gehörenden Personen mit Dauerausweis über ihren Beruf;
a)masters of merchant ships who prove their status by their certificate of competency, and all other persons belonging to the crew of a merchant ship who hold a permanent document attesting their occupation;
b)die Besatzung von fiskalischen Leuchttürmen und Wasserfahrzeugen auf Seewasserstraßen und in Küstengewässern;
b)the crews of state-owned lighthouses and vessels on maritime waterways and in coastal waters;
c)die Zivilbesatzung der Leuchttürme und der Schiffe der Reichsmarine (Werft-, Lotsendampfer, Wasserprähme, Feuerschiffe);
c)the civilian crews of the lighthouses and ships of the Reich Navy (dockyard and pilot steamers, water barges, lightships);
d)die Zivilbesatzung der Kriegsschiffe (Friseure, Köche, Kantinenpächter, Handwerker usw.) sowie alle sonstigen planmäßig oder überplanmäßig auf Kriegsschiffen eingeschifften Stimmberechtigten.
d)the civilian crews of warships (barbers, cooks, canteen keepers, craftsmen, etc.) and all other persons entitled to vote who are embarked on warships as part of the regular or supernumerary complement.
(2) Die im Abs. 1 unter b bis d aufgeführten Personen sind zur Stimmabgabe nach § 111a Reichsstimmordnung zuzulassen, wenn sie neben dem Stimmschein eine Bescheinigung der zuständigen Dienststelle vorlegen, daß sie aus dienstlichen Gründen am Wahltage ihr Stimmrecht an Land nicht ausüben können.
(2) The persons listed in para. 1 under b to d are to be admitted to vote under § 111a of the Reich Voting Regulations if, in addition to the voting certificate, they produce a certificate from the competent office that for reasons of duty they cannot exercise their right to vote on land on polling day.
§ 13Die zur Abgrenzung der Stimmbezirke zuständigen Behörden werden ermächtigt, die Abstimmungszeit für Seeleute abweichend von § 111a Ziffer 4 Reichsstimmordnung den örtlichen Bedürfnissen entsprechend festzusetzen. Die tägliche Abstimmungszeit muß mindestens zwei Stunden dauern.
§ 13The authorities responsible for defining the polling districts are empowered to fix the voting hours for seamen to suit local needs, departing from § 111a, no. 4, of the Reich Voting Regulations. The daily voting period must last at least two hours.

§ 14Für deutsche Seefahrzeuge, die in das Schiffsregister eingetragen sind und am Abstimmungstage voraussichtlich fünfzig Stimmberechtigte an Bord haben, wird ein Abstimmungsbezirk gebildet, der zum Heimathafen des Schiffes zählt. Auch wird ein Abstimmungsvorsteher und ein Stellvertreter des Abstimmungsvorstehers ernannt. Die Bildung des Abstimmungsbezirks und die Ernennung des Abstimmungsvorstehers und seines Stellvertreters obliegt der für den Heimathafen nach § 165 Reichsstimmordnung zuständigen Behörde.
§ 14For German sea-going vessels which are entered in the register of ships and are expected to have fifty persons entitled to vote on board on voting day, a polling district is formed which counts as part of the ship’s home port. A presiding officer and a deputy presiding officer are also appointed. The formation of the polling district and the appointment of the presiding officer and his deputy are the responsibility of the authority competent for the home port under § 165 of the Reich Voting Regulations.
§ 15Die Gemeindebehörde des Heimathafens versorgt das Schiff mit Abstimmungsgeräten, mit Stimmzetteln, Umschlägen und Vordrucken zur Abstimmungsniederschrift. Für Seefahrzeuge, die vor dem Wahltage nicht mit den allgemeinen Stimmzetteln versorgt werden können, werden die Stimmzettel an Bord durch Druck oder auf anderem Vervielfältigungswege hergestellt. Der für den Heimathafen zuständige Kreiswahlleiter teilt zu diesem Zwecke im Benehmen mit dem Schiffseigner dem Schiffe den Inhalt des amtlichen Stimmzettels auf dem Funkwege mit.
§ 15The municipal authority of the home port supplies the ship with voting equipment, with ballot papers, envelopes and forms for the polling record. For sea-going vessels that cannot be supplied with the general ballot papers before polling day, the ballot papers are produced on board by printing or by some other means of duplication. For this purpose the constituency returning officer responsible for the home port, in consultation with the shipowner, communicates the content of the official ballot paper to the ship by radio.
§ 16(1) Zur Teilnahme an der Abstimmung an Bord (Bordwahl) sind berechtigt solche Passagiere, die im Besitze eines Stimmscheines sind.
§ 16(1) Passengers in possession of a voting certificate are entitled to take part in the vote on board (voting on board).
(2) Zur Teilnahme an der Bordwahl sind außerdem berechtigt die mit Stimmschein versehenen Angehörigen der Schiffsbesatzung, sofern für die Besatzung keine Möglichkeit besteht, in den zehn Tagen vor oder in den fünf Tagen nach dem allgemeinen Abstimmungstag (§ 111a Reichsstimmordnung) an Land abzustimmen.
(2) Members of the ship’s crew holding a voting certificate are also entitled to take part in voting on board, provided that the crew has no opportunity to vote on land in the ten days before or the five days after the general voting day (§ 111a of the Reich Voting Regulations).
§ 17(1) Befinden sich am Wahltage auf einem Schiffe, für das ein Abstimmungsbezirk gebildet worden ist (§ 14), mindestens fünfzig nach § 16 zur Teilnahme an der Bordwahl berechtigte Stimmscheininhaber, so hat der an Bord befindliche Abstimmungsvorsteher die Bordwahl anzusetzen. Er beruft einen Abstimmungsvorstand und gibt spätestens am Tage vor dem Wahltage durch Anschlag den Abstimmungsraum und die Abstimmungszeit bekannt. Die Abstimmungszeit ist nach der Zahl der Stimmscheininhaber zu bemessen und soll so gelegt werden, daß allen Stimmscheininhabern Gelegenheit gegeben ist, an der Bordwahl teilzunehmen. Unter Umständen kann die Abstimmungshandlung unterbrochen werden. Für die Dauer der Unterbrechung ist der Spalt der Stimmurne mit Siegeln zu verschließen.
§ 17(1) If on polling day there are at least fifty holders of voting certificates entitled under § 16 to take part in voting on board a ship for which a polling district has been formed (§ 14), the presiding officer on board shall arrange the vote on board. He appoints a polling committee and, no later than the day before polling day, announces the polling room and the voting hours by a posted notice. The voting hours are to be set according to the number of certificate holders and so arranged that all certificate holders have an opportunity to take part in voting on board. Where circumstances require, the voting may be interrupted. For the duration of the interruption the slot of the ballot box is to be closed with seals.
(2) Während des Aufenthalts des Schiffes im Hafen eines fremden Staates oder in seinen Hoheitsgewässern findet eine Bordwahl nicht statt.
(2) No vote on board takes place while the ship is in the port or territorial waters of a foreign state.
§ 18Der Schiffskapitän meldet möglichst vor oder alsbald nach Antritt der Reise dem Kreiswahlleiter, erforderlichenfalls durch Funkspruch, ob an Bord seines Schiffes eine Bordwahl stattfindet.
§ 18The ship’s master reports to the constituency returning officer, if possible before or else immediately after the start of the voyage, by radio message if necessary, whether a vote on board will take place on his ship.
§ 19Das Abstimmungsergebnis wird nach den allgemeinen Vorschriften festgestellt und vom Abstimmungsvorsteher dem Kreiswahlleiter des Heimathafens unverzüglich, erforderlichenfalls durch Funkspruch, übermittelt. Die Abstimmungsniederschrift mit ihren Anlagen und die gültigen Stimmzettel (§ 126 Reichsstimmordnung) werden mit der nächsten Post dem Kreiswahlleiter übermittelt.
§ 19The result of the vote is established according to the general provisions and transmitted by the presiding officer to the constituency returning officer of the home port without delay, by radio message if necessary. The polling record with its annexes and the valid ballot papers (§ 126 of the Reich Voting Regulations) are sent to the constituency returning officer by the next post.
§ 20Im übrigen gelten die allgemeinen Wahlvorschriften auch für die Bordwahl.

§ 21In ländlichen Stimmbezirken mit weniger als 1 000 Einwohnern kann die zur Abgrenzung der Stimmbezirke zuständige Behörde, abweichend von § 112 Satz 2 Reichsstimmordnung, den Beginn der Abstimmungszeit auch früher, jedoch nicht früher als auf 7 Uhr vormittags, oder auch später, jedoch nicht später als auf 11 Uhr vormittags festsetzen; die gekürzte Abstimmungszeit muß ununterbrochen mindestens sechs Stunden dauern und darf nicht vor 2 Uhr nachmittags schließen.
§ 21In rural polling districts with fewer than 1,000 inhabitants, the authority responsible for defining the polling districts may, departing from § 112, sentence 2, of the Reich Voting Regulations, fix the start of voting earlier, but not earlier than 7 a.m., or later, but not later than 11 a.m.; the shortened voting period must last at least six hours without interruption and may not close before 2 p.m.

A voting certificate, allowing its holder to vote at a polling station other than his or her own; it was what made voting at railway stations, at the fair and on board ship possible.
