Ordinance of the Reich Minister of the Interior on the Prohibition of Communist Demonstrations in the Free State of Saxony

Frick used his power under the decree of 4 February to ban open-air meetings and marches in all or part of the Reich, forbidding those of the KPD and its auxiliary organisations in Saxony, a state still governed by a caretaker cabinet without Nazi ministers. Organisers, leaders, speakers and anyone who provided a site faced prison, and participants fines of up to 150 Reichsmarks. The ban applied from 22 February until further notice.

Ordinance of the Reich Minister of the Interior on the Prohibition of Communist Demonstrations in the Free State of Saxony.
Vom 21. Februar 1933.
Of 21 February 1933.
Auf Grund des § 5 der Verordnung des Reichspräsidenten zum Schutze des deutschen Volkes vom 4. Februar 1933 (Reichsgesetzbl. I S. 35) wird folgendes verordnet:
On the basis of § 5 of the Decree of the Reich President for the Protection of the German People of 4 February 1933 (Reich Law Gazette I p. 35), the following is ordained:
§ 1 Im Gebiete des Freistaates Sachsen sind Versammlungen unter freiem Himmel und Aufzüge, die von der Kommunistischen Partei Deutschlands, ihren Hilfs- oder Nebenorganisationen veranstaltet werden, bis auf weiteres verboten.
§ 1 In the territory of the Free State of Saxony, open-air meetings and processions organised by the Communist Party of Germany or its auxiliary or subsidiary organisations are prohibited until further notice.
§ 2 (1) Mit Gefängnis, neben dem auf Geldstrafe erkannt werden kann, wird bestraft,
§ 2 (1) The following shall be punished with imprisonment, alongside which a fine may be imposed:
1. wer unter Zuwiderhandlung gegen das Verbot des § 1 eine Versammlung unter freiem Himmel oder einen Aufzug veranstaltet oder leitet oder dabei als Redner auftritt;
1. whoever, in contravention of the prohibition in § 1, organises or leads an open-air meeting or a procession or appears at it as a speaker;
2. wer für eine Versammlung unter freiem Himmel, die nach § 1 verboten ist, den Platz zur Verfügung stellt.
2. whoever provides the site for an open-air meeting that is prohibited under § 1.
(2) Mit Geldstrafe bis zu einhundertfünfzig Reichsmark wird bestraft, wer an einer Versammlung unter freiem Himmel oder einem Aufzuge, die nach § 1 verboten sind, teilnimmt.
(2) Whoever takes part in an open-air meeting or a procession prohibited under § 1 shall be punished with a fine of up to one hundred and fifty Reichsmarks.
§ 3 Diese Verordnung tritt mit dem 22. Februar 1933 in Kraft.
§ 3 This ordinance comes into force on 22 February 1933.

§ 5 of the decree of 4 February 1933 allowed the Reich Minister of the Interior to ban open-air meetings and processions, and the wearing of political uniforms, for the whole Reich or parts of it, and to set prison or fines for contraventions. This ordinance used it against one party in one state.
Hilfs- oder Nebenorganisationen
Auxiliary or subsidiary organisations: the bodies around the KPD, such as its youth league, the Red Aid and the ‘Kampfbund gegen den Faschismus’.
Aufzug
A procession or march in the street, distinguished in German assembly law from a stationary meeting.
