Provisional Law for the Coordination of the States with the Reich

The first law made by the government alone under the Enabling Act to reach into the states. It let each state government make laws without its parliament, even in departure from the state constitution, and dissolved every state parliament except the Prussian Landtag elected on 5 March, together with the municipal councils outside Prussia. All were to be reconstituted without new elections, in proportion to the votes each party had won in that state or municipality at the Reichstag election of 5 March, with Communist votes and seats disregarded.

Die Reichsregierung hat das folgende Gesetz beschlossen, das hiermit verkündet wird:

Vereinfachung der Landesgesetzgebung

Simplification of State Legislation

§ 1 (1) Die Landesregierungen sind ermächtigt, außer in den in den Landesverfassungen vorgesehenen Verfahren Landesgesetze zu beschließen. Dies gilt auch für Gesetze, die den in Artikel 85 Abs. 2 und 87 der Reichsverfassung bezeichneten Gesetzen entsprechen.

§ 1 (1) The state governments are empowered to enact state laws otherwise than by the procedures provided for in the state constitutions. This also applies to laws corresponding to the laws referred to in Article 85, para. 2, and Article 87 of the Reich Constitution.

(2) Über Ausfertigung und Verkündung der von den Landesregierungen beschlossenen Gesetze treffen die Landesregierungen Bestimmung.

(2) The state governments shall make provision for the engrossment and promulgation of the laws enacted by the state governments.

§ 2 (1) Zur Neuordnung der Verwaltung, einschließlich der gemeindlichen Verwaltung, und zur Neuregelung der Zuständigkeiten können die von den Landesregierungen beschlossenen Landesgesetze von den Landesverfassungen abweichen.

§ 2 (1) For the reorganisation of the administration, including municipal administration, and for the new regulation of competences, the state laws enacted by the state governments may depart from the state constitutions.

(2) Die Einrichtung der gesetzgebenden Körperschaften als solche darf nicht berührt werden.

(2) The institution of the legislative bodies as such may not be affected.

§ 3 Staatsverträge, die sich auf Gegenstände der Landesgesetzgebung beziehen, bedürfen nicht der Zustimmung der an der Gesetzgebung beteiligten Körperschaften. Die Landesregierungen erlassen die zur Durchführung dieser Verträge erforderlichen Vorschriften.

§ 3 Treaties between states that relate to matters of state legislation do not require the consent of the bodies taking part in legislation. The state governments shall issue the provisions necessary to implement these treaties.

Representative Assemblies of the States

§ 4 (1) Die Volksvertretungen der Länder (Landtage, Bürgerschaften) werden mit Ausnahme des am 5. März 1933 gewählten Preußischen Landtags hiermit aufgelöst, soweit dies nicht bereits nach Landesrecht geschehen ist.

§ 4 (1) The representative assemblies of the states (Landtage, Bürgerschaften), with the exception of the Prussian Landtag elected on 5 March 1933, are hereby dissolved, in so far as this has not already happened under state law.

(2) Sie werden neu gebildet nach den Stimmenzahlen, die bei der Wahl zum Deutschen Reichstag am 5. März 1933 innerhalb eines jeden Landes auf die Wahlvorschläge entfallen sind. Hierbei werden die auf Wahlvorschläge der Kommunistischen Partei entfallenden Sitze nicht zugeteilt. Dasselbe gilt für Wahlvorschläge von Wählergruppen, die als Ersatz von Wahlvorschlägen der Kommunistischen Partei anzusehen sind.

(2) They shall be reconstituted according to the numbers of votes cast for the lists of candidates within each state at the election to the German Reichstag on 5 March 1933. In this, the seats falling to lists of the Communist Party shall not be allocated. The same applies to lists of groups of voters that are to be regarded as substitutes for lists of the Communist Party.

§ 5 (1) In den Ländern Bayern, Sachsen, Württemberg und Baden werden den Wählergruppen so viele Sitze zugewiesen, als die Verteilungszahl in der Gesamtzahl der für ihre Wahlvorschläge abgegebenen Stimmen enthalten ist. Dabei wird ein Rest von mehr als der Hälfte der Verteilungszahl der vollen Verteilungszahl gleichgeachtet.

§ 5 (1) In the states of Bavaria, Saxony, Württemberg and Baden, each group of voters shall be allotted as many seats as the quota is contained in the total number of votes cast for its lists. A remainder of more than half the quota shall count as a full quota.

(2) Die Verteilungszahl wird festgesetzt für Bayern und Sachsen auf je 40 000, für Württemberg auf 25 000 und für Baden auf 21 000.

(2) The quota is fixed at 40,000 each for Bavaria and Saxony, at 25,000 for Württemberg and at 21,000 for Baden.

§ 6 (1) In den Ländern Thüringen, Hessen, Hamburg, Mecklenburg-Schwerin, Oldenburg, Braunschweig, Anhalt, Bremen, Lippe, Lübeck, Mecklenburg-Strelitz und Schaumburg-Lippe darf die Zahl der Mitglieder der neu zu bildenden Landtage (Bürgerschaften) die folgenden Höchstziffern nicht überschreiten:

§ 6 (1) In the states of Thuringia, Hesse, Hamburg, Mecklenburg-Schwerin, Oldenburg, Brunswick, Anhalt, Bremen, Lippe, Lübeck, Mecklenburg-Strelitz and Schaumburg-Lippe, the number of members of the Landtage (Bürgerschaften) to be newly constituted may not exceed the following maximum figures:

(2) Die den Wählergruppen nach Abs. 1 zustehenden Abgeordnetensitze werden nach dem geltenden Landeswahlrecht ermittelt. Nach Landeswahlrecht festgesetzte Verteilungszahlen werden indessen so erhöht, daß die durch Abs. 1 bestimmte Höchstzahl von Mitgliedern nicht überschritten wird.

(2) The seats due to the groups of voters under para. 1 shall be determined according to the state electoral law in force. Quotas fixed under state electoral law shall, however, be raised so that the maximum number of members set by para. 1 is not exceeded.

§ 7 (1) Die Sitze werden den Bewerbern auf Grund von Wahlvorschlägen zugewiesen, die die Wählergruppen bis spätestens 13. April 1933 einzureichen haben. Zur Einreichung von Wahlvorschlägen sind alle Wählergruppen befugt, auf deren Wahlvorschlag am 5. März 1933 Stimmen entfallen sind; dies gilt nicht für die Kommunistische Partei und solche Wählergruppen, deren Wahlvorschläge als Ersatz von Wahlvorschlägen der Kommunistischen Partei anzusehen sind.

§ 7 (1) The seats shall be allotted to candidates on the basis of lists which the groups of voters must submit by 13 April 1933 at the latest. All groups of voters whose list received votes on 5 March 1933 are entitled to submit lists; this does not apply to the Communist Party or to such groups of voters whose lists are to be regarded as substitutes for lists of the Communist Party.

(2) Verbindungen und Anschlüsse sind nur insoweit zulässig, als sie bei der Reichstagswahl am 5. März 1933 getätigt waren.

(2) Combinations and affiliations of lists are permissible only in so far as they were made at the Reichstag election of 5 March 1933.

(3) Wahlbewerbern, die bis zum 5. März 1933 zur Kommunistischen Partei gehörten, werden Sitze nicht zugewiesen.

(3) Seats shall not be allotted to candidates who belonged to the Communist Party up to 5 March 1933.

§ 8 Die neuen Landtage (Bürgerschaften) gelten mit dem 5. März 1933 als auf vier Jahre gewählt. Eine vorzeitige Auflösung ist unzulässig. Dies gilt auch für den am 5. März 1933 gewählten Preußischen Landtag.

§ 8 The new Landtage (Bürgerschaften) are deemed to have been elected on 5 March 1933 for four years. Early dissolution is not permissible. This also applies to the Prussian Landtag elected on 5 March 1933.

§ 9 Die Neubildung der Landtage (Bürgerschaften) nach diesem Gesetz muß bis zum 15. April 1933 durchgeführt sein.

§ 9 The reconstitution of the Landtage (Bürgerschaften) under this law must be completed by 15 April 1933.

§ 10 Die Zuteilung von Sitzen auf Wahlvorschläge der Kommunistischen Partei für den Reichstag und den Preußischen Landtag auf Grund des Wahlergebnisses vom 5. März 1933 ist unwirksam. Ersatzzuteilung findet nicht statt.

§ 10 The allocation of seats to lists of the Communist Party for the Reichstag and the Prussian Landtag on the basis of the election result of 5 March 1933 is void. No substitute allocation takes place.

§ 11 Eine Auflösung des Reichstags bewirkt ohne weiteres die Auflösung der Volksvertretungen der Länder.

§ 11 A dissolution of the Reichstag automatically brings about the dissolution of the representative assemblies of the states.

Gemeindliche Selbstverwaltungskörper

Municipal Self-Governing Bodies

§ 12 (1) Die gemeindlichen Selbstverwaltungskörper (Kreistage, Bezirkstage, Bezirksräte, Amtsversammlungen, Stadträte, Stadtverordnetenversammlungen, Gemeinderäte usw.), auf welche die Grundsätze nach Artikel 17 Abs. 2 der Reichsverfassung Anwendung finden, werden hiermit aufgelöst.

§ 12 (1) The municipal self-governing bodies (district assemblies, regional assemblies, regional councils, Amt assemblies, town councils, assemblies of town councillors, municipal councils, etc.) to which the principles under Article 17, para. 2, of the Reich Constitution apply are hereby dissolved.

(2) Sie werden neu gebildet nach der Zahl der gültigen Stimmen, die bei der Wahl zum Deutschen Reichstag am 5. März 1933 im Gebiet der Wahlkörperschaft abgegeben worden sind. Dabei bleiben Stimmen unberücksichtigt, die auf Wahlvorschläge der Kommunistischen Partei oder solche entfallen sind, die als Ersatz von Wahlvorschlägen der Kommunistischen Partei anzusehen sind.

(2) They shall be reconstituted according to the number of valid votes cast in the area of the electing body at the election to the German Reichstag on 5 March 1933. Votes cast for lists of the Communist Party, or for lists that are to be regarded as substitutes for lists of the Communist Party, shall be disregarded.

§ 13 (1) Bei den Vertretungskörperschaften in der unteren Selbstverwaltung (Gemeinde-, Stadträte usw.) darf die Zahl der Mitglieder die folgenden Höchstziffern nicht überschreiten:

§ 13 (1) In the representative bodies of lower-level self-government (municipal and town councils, etc.), the number of members may not exceed the following maximum figures:

in Gemeinden bis zu 1 000 Einwohnern 9, bis zu 2 000 Einwohnern 10, bis zu 5 000 Einwohnern 12, bis zu 10 000 Einwohnern 16, bis zu 15 000 Einwohnern 20, bis zu 25 000 Einwohnern 24, bis zu 30 000 Einwohnern 26, bis zu 40 000 Einwohnern 29, bis zu 50 000 Einwohnern 31, bis zu 60 000 Einwohnern 33, bis zu 80 000 Einwohnern 35, bis zu 100 000 Einwohnern 37, bis zu 200 000 Einwohnern 45, bis zu 300 000 Einwohnern 53, bis zu 400 000 Einwohnern 58, bis zu 500 000 Einwohnern 63, bis zu 600 000 Einwohnern 68, bis zu 700 000 Einwohnern 73, in Gemeinden von mehr als 700 000 Einwohnern 77.

(2) Die übrigen Vertretungskörperschaften der gemeindlichen Selbstverwaltung sind gegenüber ihrem Bestand vor der Auflösung (§ 12) möglichst um fünfundzwanzig vom Hundert zu verkleinern.

(2) The other representative bodies of municipal self-government shall, as far as possible, be reduced by twenty-five per cent from their strength before the dissolution (§ 12).

§ 14 (1) Die den Wählergruppen nach § 12 Abs. 2 zustehenden Sitze werden nach dem geltenden Landesrecht ermittelt. Nach Landesrecht bestehende Verteilungszahlen sind entsprechend festzusetzen. Die Sitze werden den Bewerbern auf Grund von Wahlvorschlägen zugewiesen, die die Wählergruppen einzureichen haben. Auch hier gilt § 7 Abs. 3.

§ 14 (1) The seats due to the groups of voters under § 12, para. 2, shall be determined according to the state law in force. Quotas existing under state law shall be fixed accordingly. The seats shall be allotted to candidates on the basis of lists which the groups of voters must submit. Here too § 7, para. 3, applies.

(2) Zur Einreichung von Wahlvorschlägen sind alle Wählergruppen befugt, auf deren Wahlvorschlag im Gebiet der Wahlkörperschaft am 5. März 1933 Stimmen entfallen sind; dies gilt nicht für die Kommunistische Partei und solche Wählergruppen, deren Wahlvorschläge als Ersatz von Wahlvorschlägen der Kommunistischen Partei anzusehen sind.

(2) All groups of voters whose list received votes in the area of the electing body on 5 March 1933 are entitled to submit lists; this does not apply to the Communist Party or to such groups of voters whose lists are to be regarded as substitutes for lists of the Communist Party.

(3) Eine zur Einreichung von Wahlvorschlägen berechtigte Wählergruppe (Abs. 2) kann sich mit anderen oder allen Wählergruppen zur Einreichung eines gemeinsamen Wahlvorschlags verbinden.

(3) A group of voters entitled to submit lists (para. 2) may combine with other groups of voters, or with all of them, to submit a joint list.

§ 15 Die neuen gemeindlichen Selbstverwaltungskörper gelten mit dem 5. März 1933 als auf vier Jahre gewählt.

§ 15 The new municipal self-governing bodies are deemed to have been elected on 5 March 1933 for four years.

§ 16 Die Neubildung der gemeindlichen Selbstverwaltungskörper nach diesem Gesetz muß bis zum 30. April 1933 durchgeführt sein.

§ 16 The reconstitution of the municipal self-governing bodies under this law must be completed by 30 April 1933.

§ 17 Die §§ 12 bis 16 finden auf die gemeindlichen Selbstverwaltungskörper in Preußen keine Anwendung. Indessen gilt § 10 für sie entsprechend.

§ 17 §§ 12 to 16 do not apply to the municipal self-governing bodies in Prussia. § 10, however, applies to them correspondingly.

Gemeinsame Bestimmungen

Common Provisions

§ 18 Der Reichsminister des Innern wird ermächtigt, Bestimmungen zur Ergänzung und Ausführung dieses Gesetzes zu erlassen. Im übrigen obliegt die Ausführung des Gesetzes, soweit es sich um Angelegenheiten des Reichs handelt, dem Reichsminister des Innern, soweit es sich um Angelegenheiten der Länder handelt, den Landesregierungen. Der Reichsminister des Innern kann allgemeine Anweisungen erlassen und auf Antrag einer Landesregierung Ausnahmen von dem Gesetz zulassen.

§ 18 The Reich Minister of the Interior is empowered to issue provisions supplementing and implementing this law. Otherwise the implementation of the law is the responsibility of the Reich Minister of the Interior in so far as matters of the Reich are concerned, and of the state governments in so far as matters of the states are concerned. The Reich Minister of the Interior may issue general instructions and, on the application of a state government, permit exceptions from the law.

§ 19 Die Vorschriften der §§ 1 bis 3 und des § 18 finden auch auf solche Regierungen in den Ländern Anwendung, die aus Kommissaren oder Beauftragten des Reichs bestehen.

§ 19 The provisions of §§ 1 to 3 and of § 18 also apply to such governments in the states as consist of commissioners or representatives of the Reich.

The English translation was made for this site and is not an official translation. ‘Wahlvorschläge’ (literally ‘election proposals’) is translated as ‘lists’ or ‘lists of candidates’, and ‘Wählergruppen’ as ‘groups of voters’. ‘Landtag’ (state parliament) and ‘Bürgerschaft’ (the parliament of the city-states Hamburg, Bremen and Lübeck) are left in German where the law names them as institutions.

Terms

Gleichschaltung: ‘Coordination’: the regime’s word for bringing institutions into line with the Nazi state. The law applied it to the states’ parliaments and governments; the word was soon used of every kind of organisation.
Volksvertretungen der Länder (Landtage, Bürgerschaften): The elected parliaments of the German states. Germany in 1933 consisted of seventeen states, of which Prussia was much the largest; the city-states called their parliaments Bürgerschaften.
Kommunistische Partei: The KPD had won 81 Reichstag seats on 5 March 1933. Its deputies had not been allowed to take them up; § 10 annulled the allocation outright, and §§ 4, 7, 12 and 14 excluded the party and any ‘substitute’ lists from the reconstituted assemblies.
Artikel 17 Abs. 2 der Reichsverfassung: The Weimar constitution’s requirement that municipal representatives be elected by universal, equal, direct and secret ballot on the principles of proportional representation.
Verteilungszahl: The quota: the number of votes needed for one seat under the states’ electoral laws.
