Ordinance on the Provisional Regulation of the Flying of Flags
Verordnung über die vorläufige Regelung der Flaggenführung
Following Hindenburg’s decree of 12 March, which had replaced the republic’s black-red-gold flag with the black-white-red flag of the Empire and the swastika flag flown side by side, this ordinance brought the service flags of the civil Reich authorities into line. The Reich Post flag and the flag of Reich authorities at sea became black-white-red, Reich vessels were to fly the swastika flag as well where possible, and merchant ships could fly black-white-red in place of the republic’s merchant flag. All of it was ‘provisional’, pending a final settlement of the Reich colours.

In Abänderung des Abschnitts I der Verordnung über die deutschen Flaggen vom 11. April 1921 (Reichsgesetzbl. S. 483) in der Fassung der Zweiten Verordnung über die deutschen Flaggen vom 5. Mai 1926 (Reichsgesetzbl. I S. 217) bestimme ich zur Anpassung der Dienstflaggen der zivilen Reichsbehörden an die durch meinen Erlaß über die vorläufige Regelung der Flaggenhissung vom 12. März 1933 (Reichsgesetzbl. I S. 103) getroffene Anordnung bis zur endgültigen Regelung der Reichsfarben folgendes:
In amendment of Section I of the Ordinance on the German Flags of 11 April 1921 (Reich Law Gazette, p. 483), as amended by the Second Ordinance on the German Flags of 5 May 1926 (Reich Law Gazette I, p. 217), I direct the following, pending the final regulation of the Reich colours, in order to bring the service flags of the civil Reich authorities into line with the arrangement made by my Decree on the Provisional Regulation of the Hoisting of Flags of 12 March 1933 (Reich Law Gazette I, p. 103):
1.Die Reichspostflagge (Abschnitt I Ziffer 8 der Verordnung über die deutschen Flaggen) hat die gleich breiten Querstreifen schwarz-weiß-rot, in der Mitte des weißen Querstreifens ein goldgelbes Posthorn mit schwarz-weiß-roter Schnur und einer ebensolchen Quaste, das Mundstück nach der Stange gewendet. Der weiße Streifen ist über und unter dem Posthorn bogenförmig um je ein Fünftel verbreitert.
1.The Reich Post flag (Section I, no. 8, of the Ordinance on the German Flags) has horizontal stripes of equal width, black-white-red, and in the middle of the white stripe a golden-yellow post horn with a black-white-red cord and a tassel of the same, the mouthpiece turned towards the staff. The white stripe is widened above and below the post horn in an arc by one fifth each.
2.Die Dienstflagge der übrigen Reichsbehörden zur See (Abschnitt I Ziffer 10 der Verordnung über die deutschen Flaggen) besteht aus drei gleich breiten Querstreifen, oben schwarz, in der Mitte weiß, unten rot; im weißen Streifen, etwas nach der Stange hin verschoben, der Reichsadler. Der weiße Streifen ist über und unter dem Reichsadler bogenförmig um etwa je ein Fünftel verbreitert.
2.The service flag of the other Reich authorities at sea (Section I, no. 10, of the Ordinance on the German Flags) consists of three horizontal stripes of equal width, black at the top, white in the middle and red at the bottom; in the white stripe, set somewhat towards the staff, the Reich eagle. The white stripe is widened above and below the Reich eagle in an arc by about one fifth each.
3.Die Dienstfahrzeuge des Reichs auf Binnengewässern führen am Heck die schwarz-weiß-rote Flagge. Soweit dafür eine Möglichkeit besteht, setzen sie außerdem die Hakenkreuzflagge.
3.Service vessels of the Reich on inland waters fly the black-white-red flag at the stern. Where there is a possibility of doing so, they also hoist the swastika flag.
4.Die Dienstfahrzeuge des Reichs zur See führen die unter 2 beschriebene Dienstflagge der Reichsbehörden zur See. Soweit dafür eine Möglichkeit besteht, setzen sie außerdem die Hakenkreuzflagge.
4.Service vessels of the Reich at sea fly the service flag of the Reich authorities at sea described under 2. Where there is a possibility of doing so, they also hoist the swastika flag.

Auf Grund des § 1 Absatz 2 des Gesetzes, betreffend das Flaggenrecht der Kauffahrteischiffe, vom 22. Juni 1899 (Reichsgesetzbl. S. 319) verordne ich:
On the basis of § 1, para. 2, of the Law concerning the Right of Merchant Ships to Fly the Flag of 22 June 1899 (Reich Law Gazette, p. 319), I ordain:
Kauffahrteischiffe können bis zur endgültigen Regelung der Reichsfarben abweichend von Abschnitt II der Verordnung über die deutschen Flaggen an Stelle der Handelsflagge die schwarz-weiß-rote Flagge führen.
Pending the final regulation of the Reich colours, merchant ships may, in derogation from Section II of the Ordinance on the German Flags, fly the black-white-red flag in place of the merchant flag.

The English translation was made for this site and is not an official translation. The President’s measure is a ‘Verordnung’ issued under the 1921 flag ordinance and the 1899 merchant flag law, not under Article 48, so it is called an ordinance here, as on the day pages. ‘Dienstflagge’ is rendered as ‘service flag’ and ‘Kauffahrteischiffe’ as ‘merchant ships’.

Terms
schwarz-weiß-rot
Black-white-red: the colours of the German Empire of 1871, used by the monarchist right against the republic’s black-red-gold. Under the Weimar constitution the merchant flag was black-white-red with a small black-red-gold canton.
Erlaß vom 12. März 1933
Hindenburg’s decree of 12 March 1933 ordered that, pending a final settlement, the black-white-red flag and the swastika flag be hoisted together on public buildings, in place of the black-red-gold flag.
Hakenkreuzflagge
The swastika flag of the NSDAP. It became the sole national flag under the Reich Flag Law of 15 September 1935.
Handelsflagge
The merchant flag fixed by Section II of the 1921 flag ordinance, which Part II of this ordinance allowed ships to replace.
