Verordnung über die Zulassung von Ärzten zur Tätigkeit bei den Krankenkassen
Ended the work of panel doctors (Kassenärzte) of ‘non-Aryan’ descent and of those who had been active ‘in the Communist sense’ with the health insurance funds, on which most patients and so most doctors’ livelihoods depended, and barred new admissions. Registration now required German citizenship and ‘Aryan’ descent, proved with documents for the doctor’s parents and grandparents. Doctors who had served in the war, at the front or as doctors in epidemic hospitals, those whose fathers or sons had fallen, and those in practice since 1 August 1914 were exempt from the ‘Aryan’ rule; Communists were not. The doctors’ own insurance associations were to declare admissions ended from 1 July 1933, with an appeal only to the Labour Minister.

Auf Grund des § 368i Abs. 1 Nr. 2 und Abs. 3 der Reichsversicherungsordnung verordne ich an Stelle des Reichsausschusses für Ärzte und Krankenkassen:
On the basis of § 368i, para. 1, no. 2, and para. 3, of the Reich Insurance Code, I ordain, in place of the Reich Committee for Doctors and Health Insurance Funds:
Artikel I
Article I
(1) Die Tätigkeit von Kassenärzten nicht arischer Abstammung und von Kassenärzten, die sich im kommunistischen Sinne betätigt haben, wird beendet. Neuzulassungen solcher Ärzte zur Tätigkeit bei den Krankenkassen finden nicht mehr statt.
(1) The practice of panel doctors of non-Aryan descent and of panel doctors who have been active in the Communist sense is ended. New admissions of such doctors to practice for the health insurance funds no longer take place.
(2) Die Durchführung dieser Vorschriften erfolgt nach Maßgabe des Artikels II.

Die Ausführungs- und Überleitungsbestimmungen über das kassenärztliche Dienstverhältnis, Zweiter Teil (Zulassungsordnung) vom 30. Dezember 1931 (Reichsgesetzbl. 1932 I S. 2, 8), werden wie folgt geändert:
The Implementing and Transitional Provisions on the Service Relationship of Panel Doctors, Part Two (Admission Regulations), of 30 December 1931 (Reichsgesetzbl. 1932 I pp. 2, 8) are amended as follows:
1.§ 7 Abs. 4 erhält folgende Fassung:
1.§ 7, para. 4, is worded as follows:
„Die Eintragung ist nur zulässig, wenn der Arzt deutscher Reichsangehöriger und arischer Abstammung ist, sich im Besitze der bürgerlichen Ehrenrechte befindet, seit mindestens zwei Jahren ärztliche Tätigkeit ausübt und sich nicht im kommunistischen Sinne betätigt hat. Die nicht arische Abstammung ist kein Hindernis für die Eintragung, wenn die Ärzte am Weltkriege auf seiten des Deutschen Reichs oder seiner Verbündeten teilgenommen haben oder wenn ihre Väter oder Söhne im Weltkriege gefallen sind.“
‘Registration is permissible only if the doctor is a German national of the Reich and of Aryan descent, is in possession of his civic rights, has practised medicine for at least two years and has not been active in the Communist sense. Non-Aryan descent is no obstacle to registration if the doctors took part in the World War on the side of the German Reich or its allies, or if their fathers or sons were killed in the World War.’
2.§ 8 Abs. 3 erhält folgende Fassung:

„Dem Antrage sind beizufügen
‘The application shall be accompanied by
a)die Geburtsurkunde sowie Urkunden, aus denen hervorgeht, daß sowohl der Antragsteller wie seine Eltern und seine Großeltern arisch sind,
a)the birth certificate and documents showing that the applicant as well as his parents and his grandparents are Aryan,
b)bei Ärzten nicht arischer Abstammung, deren Väter oder Söhne im Weltkriege gefallen sind, die entsprechenden Nachweise,
b)in the case of doctors of non-Aryan descent whose fathers or sons were killed in the World War, the corresponding proof,
c)bei Ärzten nicht arischer Abstammung, die am Weltkriege teilgenommen haben, Nachweise über ihre Kampftätigkeit oder ihre ärztliche Tätigkeit an der Front oder in einem Seuchenlazarett,
c)in the case of doctors of non-Aryan descent who took part in the World War, proof of their service in combat or of their medical service at the front or in an epidemic hospital,
d)die Approbationsurkunde,
d)the certificate of licence to practise medicine,
e)die Bescheinigungen über die bisherige praktische klinische und die sonstige ärztliche Tätigkeit.“

3.§ 11 Abs. 2 erhält folgende Nr. 5:

4.§ 15 Satz 1 erhält folgende Fassung:

„Für die Entscheidung in Zulassungsangelegenheiten ist unbeschadet der Vorschriften der §§ 27a bis 27c das Schiedsamt bei dem Oberversicherungsamt zuständig, bei dem das Arztregister geführt wird.“
‘Without prejudice to the provisions of §§ 27a to 27c, decisions in matters of admission are the responsibility of the arbitration board at the Higher Insurance Office at which the register of doctors is kept.’
5.§ 22 erhält folgende neue Absätze 2 und 3:

„(2) Das gleiche gilt für Ärzte nicht arischer Abstammung, es sei denn, daß sie im Weltkriege an der Front für das Deutsche Reich oder für seine Verbündeten gekämpft haben oder an der Front oder in einem Seuchenlazarett als Ärzte tätig gewesen sind oder daß ihre Väter oder Söhne im Weltkriege gefallen sind.
‘(2) The same applies to doctors of non-Aryan descent, unless they fought at the front in the World War for the German Reich or for its allies, or served as doctors at the front or in an epidemic hospital, or their fathers or sons were killed in the World War.
(3) Von der Zulassung sind solche Ärzte ausgeschlossen, die sich im kommunistischen Sinne betätigt haben.“

6.Hinter § 27 werden folgende Paragraphen eingeschaltet:

§ 27a(1) Die kassenärztlichen Vereinigungen haben die Zulassung solcher Ärzte mit Wirkung vom 1. Juli 1933 ab für beendet zu erklären, die nach § 22 Abs. 2 und 3 nicht zugelassen werden dürften. Dies gilt nicht für Ärzte, die bereits seit dem 1. August 1914 niedergelassen sind, es sei denn, daß sie sich in kommunistischem Sinne betätigt haben.
§ 27a(1) The associations of panel doctors shall declare ended, with effect from 1 July 1933, the admission of those doctors who could not be admitted under § 22, paras. 2 and 3. This does not apply to doctors who have been established in practice since 1 August 1914, unless they have been active in the Communist sense.
(2) Die kassenärztlichen Vereinigungen haben ihre Entscheidung dem Arzte und dem Vorstande des Verbandes der Ärzte Deutschlands unter Angabe der Gründe mitzuteilen.
(2) The associations of panel doctors shall communicate their decision, stating the reasons, to the doctor and to the executive board of the Association of German Doctors.
§ 27bGegen die Entscheidung der kassenärztlichen Vereinigung steht dem Arzte binnen 2 Wochen nach Eingang der Mitteilung die Beschwerde an den Reichsarbeitsminister zu. Die Beschwerde hat keine aufschiebende Wirkung; sie ist bei dem Vorstande des Verbandes der Ärzte Deutschlands einzureichen. Der Vorstand hat den Sachverhalt zu prüfen, nötigenfalls für Ergänzung der Unterlagen zu sorgen, die Beschwerde unter Beifügung einer gutachtlichen Äußerung alsbald an den Reichsarbeitsminister zur endgültigen Entscheidung weiterzugeben und die kassenärztliche Vereinigung über die Einlegung der Beschwerde zu unterrichten.
§ 27bAgainst the decision of the association of panel doctors the doctor may, within 2 weeks of receiving the communication, appeal to the Reich Minister of Labour. The appeal has no suspensive effect; it is to be lodged with the executive board of the Association of German Doctors. The board shall examine the facts, see to it that the documentation is completed where necessary, forward the appeal without delay, together with an expert opinion, to the Reich Minister of Labour for final decision, and inform the association of panel doctors that the appeal has been lodged.
§ 27cIst zu befürchten, daß die Beendigung der Zulassung nach §§ 27a und 27b die ärztliche Versorgung der Versicherten ernstlich gefährdet, so können die kassenärztliche Vereinigung oder bei Entscheidung auf Beschwerde der Reichsarbeitsminister den Zeitpunkt für die Beendigung hinausschieben, bis die ärztliche Versorgung ausreichend geregelt ist.
§ 27cIf it is to be feared that ending admissions under §§ 27a and 27b would seriously endanger the medical care of the insured, the association of panel doctors or, where a decision is made on appeal, the Reich Minister of Labour may postpone the date of ending until medical care has been adequately arranged.
§ 27d(1) Ist der kassenärztlichen Vereinigung nicht innerhalb von 4 Wochen nach Mitteilung ihrer Entscheidung an den Arzt vom Vorstande des Verbandes der Ärzte Deutschlands Nachricht über die Einlegung der Beschwerde zugegangen, so teilt sie ihre Entscheidung dem Reichsarztregister mit.
§ 27d(1) If the association of panel doctors has not received notice from the executive board of the Association of German Doctors within 4 weeks of communicating its decision to the doctor that an appeal has been lodged, it shall communicate its decision to the Reich Register of Doctors.
(2) Der Reichsarbeitsminister teilt seine Entscheidungen dem Arzte und dem Reichsarztregister mit.
(2) The Reich Minister of Labour communicates his decisions to the doctor and to the Reich Register of Doctors.
(3) Das Reichsarztregister benachrichtigt das zuständige Oberversicherungsamt und von den Entscheidungen des Reichsarbeitsministers auch die kassenärztliche Vereinigung.
(3) The Reich Register of Doctors notifies the competent Higher Insurance Office and, of the decisions of the Reich Minister of Labour, also the association of panel doctors.
§ 27eDer Arzt darf die Fortsetzung seiner Tätigkeit nicht deswegen verweigern, weil die Beendigung seiner Zulassung gemäß §§ 27a und 27b zu erwarten ist.
§ 27eThe doctor may not refuse to continue his practice on the ground that the ending of his admission under §§ 27a and 27b is to be expected.

Diese Verordnung tritt mit dem auf die Verkündung folgenden Tage in Kraft.
