Law on Admission to the Legal Profession

Gesetz über die Zulassung zur Rechtsanwaltschaft

The companion to the Civil Service law for the independent legal profession. The admission of lawyers ‘not of Aryan descent’ in the sense of the Civil Service law could be withdrawn until 30 September 1933, and new admissions refused, with the same exemptions for those admitted before 1 August 1914, front-line veterans and those whose fathers or sons had fallen. Anyone who had been active ‘in the communist sense’ was excluded outright. Pending a decision, the justice administration could bar a lawyer from practising, and a lawyer struck off lost the protection of his office and home leases and his staff contracts.

Law on Admission to the Legal Profession.
Vom 7. April 1933.

Die Reichsregierung hat das folgende Gesetz beschlossen, das hiermit verkündet wird:
The Reich Government has enacted the following law, which is hereby promulgated:
§ 1 Die Zulassung von Rechtsanwälten, die im Sinne des Gesetzes zur Wiederherstellung des Berufsbeamtentums vom 7. April 1933 (Reichsgesetzbl. I S. 175) nicht arischer Abstammung sind, kann bis zum 30. September 1933 zurückgenommen werden.
§ 1 The admission of lawyers who are not of Aryan descent within the meaning of the Law for the Restoration of the Professional Civil Service of 7 April 1933 (Reich Law Gazette I, p. 175) may be withdrawn until 30 September 1933.
Die Vorschrift des Abs. 1 gilt nicht für Rechtsanwälte, die bereits seit dem 1. August 1914 zugelassen sind oder im Weltkriege an der Front für das Deutsche Reich oder für seine Verbündeten gekämpft haben oder deren Väter oder Söhne im Weltkriege gefallen sind.
The provision of para. 1 does not apply to lawyers who have been admitted since 1 August 1914, or who fought at the front in the World War for the German Reich or for its allies, or whose fathers or sons fell in the World War.
§ 2 Die Zulassung zur Rechtsanwaltschaft kann Personen, die im Sinne des Gesetzes zur Wiederherstellung des Berufsbeamtentums vom 7. April 1933 (Reichsgesetzbl. I S. 175) nicht arischer Abstammung sind, versagt werden, auch wenn die in der Rechtsanwaltsordnung hierfür vorgesehenen Gründe nicht vorliegen. Das gleiche gilt von der Zulassung eines der im § 1 Abs. 2 bezeichneten Rechtsanwälte bei einem anderen Gericht.
§ 2 Admission to the legal profession may be refused to persons who are not of Aryan descent within the meaning of the Law for the Restoration of the Professional Civil Service of 7 April 1933 (Reich Law Gazette I, p. 175), even if the grounds provided for this in the Lawyers’ Code are not present. The same applies to the admission of one of the lawyers described in § 1, para. 2, to another court.
§ 3 Personen, die sich in kommunistischem Sinne betätigt haben, sind von der Zulassung zur Rechtsanwaltschaft ausgeschlossen. Bereits erteilte Zulassungen sind zurückzunehmen.
§ 3 Persons who have been active in the communist sense are excluded from admission to the legal profession. Admissions already granted are to be withdrawn.
§ 4 Die Justizverwaltung kann gegen einen Rechtsanwalt bis zur Entscheidung darüber, ob von der Befugnis zur Zurücknahme der Zulassung gemäß § 1 Abs. 1 oder § 3 Gebrauch gemacht wird, ein Vertretungsverbot erlassen. Auf das Vertretungsverbot finden die Vorschriften des § 91b Abs. 2 bis 4 der Rechtsanwaltsordnung (Reichsgesetzbl. 1933 I S. 120) entsprechende Anwendung.
§ 4 Until a decision is taken on whether the power to withdraw admission under § 1, para. 1, or § 3 is to be used, the justice administration may issue an order barring a lawyer from acting for clients. The provisions of § 91b, paras. 2 to 4, of the Lawyers’ Code (Reich Law Gazette 1933 I, p. 120) apply correspondingly to the bar.
Gegen Rechtsanwälte der im § 1 Abs. 2 bezeichneten Art ist das Vertretungsverbot nur zulässig, wenn es sich um die Anwendung des § 3 handelt.
Against lawyers of the kind described in § 1, para. 2, the bar is permissible only where § 3 is to be applied.
§ 5 Die Zurücknahme der Zulassung zur Rechtsanwaltschaft gilt als wichtiger Grund zur Kündigung der von dem Rechtsanwalt als Dienstberechtigten abgeschlossenen Dienstverträge.
§ 5 The withdrawal of admission to the legal profession counts as good cause for terminating the service contracts concluded by the lawyer as employer.
§ 6 Ist die Zulassung eines Rechtsanwalts auf Grund dieses Gesetzes zurückgenommen, so finden auf die Kündigung von Mietverhältnissen über Räume, die der Rechtsanwalt für sich oder seine Familie gemietet hatte, die Vorschriften des Gesetzes über das Kündigungsrecht der durch das Gesetz zur Wiederherstellung des Berufsbeamtentums betroffenen Personen vom 7. April 1933 (Reichsgesetzbl. I S. 187) entsprechende Anwendung. Das gleiche gilt für Angestellte von Rechtsanwälten, die dadurch stellungslos geworden sind, daß die Zulassung des Rechtsanwalts zurückgenommen oder gegen ihn ein Vertretungsverbot gemäß § 4 erlassen ist.
§ 6 If a lawyer’s admission has been withdrawn under this law, the provisions of the Law on the Right of Termination of Persons Affected by the Law for the Restoration of the Professional Civil Service of 7 April 1933 (Reich Law Gazette I, p. 187) apply correspondingly to the termination of tenancies of premises that the lawyer had rented for himself or his family. The same applies to employees of lawyers who have lost their positions because the lawyer’s admission was withdrawn or a bar under § 4 was issued against him.

‘Not of Aryan descent’, as defined for the Civil Service law by its First Implementing Ordinance of 11 April 1933: anyone with one parent or grandparent of the Jewish religion.
Zulassung
Admission: a lawyer in Germany was admitted to practise before a particular court. Withdrawing it ended the right to practise.
in kommunistischem Sinne
‘In the communist sense’: the law did not define the phrase, which left the justice administrations wide discretion.
Rechtsanwaltsordnung
The Lawyers’ Code of 1878, as republished in 1933. Its § 91b allowed a lawyer facing disciplinary proceedings to be barred from practice in the meantime.
