Malicious Attacks Decree
Verordnung des Reichspräsidenten zur Abwehr heimtückischer Angriffe gegen die Regierung der nationalen Erhebung
Decree of the Reich President for the Defence against Malicious Attacks on the Government of the National Uprising
The decree made it a crime to possess or wear the uniform or badge of an organisation supporting the government without being a member, and punished crimes committed in such a uniform with penal servitude, and in especially serious cases with death. Its § 3 made it an offence to spread untrue or grossly distorted statements liable to harm the Reich, a state, or the reputation of the government and the parties behind it. Cases went to the Special Courts created the same day, and the decree became the basis for prosecuting everyday remarks critical of the regime; it was replaced by the broader ‘Heimtückegesetz’ of December 1934.

Transcribed from the RGBl. scan (issue 24, p. 135); compared word by word with German Wikisource, which differs in two places (‘Aufgrund’ for the gazette’s ‘Auf Grund’ in the preamble, and an added comma before ‘oder dem Deutschen Reich’ in § 2, para. 2); the gazette’s forms are kept. documentArchiv.de, also compared, has three further errors in § 3 and § 5 (‘Verbänden’, ‘schwere Strafe’, ‘Verkündigung’).
The English translation was made for this site and is not an official translation. ‘Heimtückisch’ is rendered as ‘malicious’; it also carries the sense of ‘treacherous’ or ‘insidious’. ‘Verband’ is translated as ‘organisation’: the decree meant the NSDAP’s SA and SS and the Stahlhelm, without naming them.
